On the morning of 9-1-2020 somewhere around the 11 am hour, I caused quite a disturbance that required the Manager John Zabatta to inquire of me. It would seem that the color and the shape of my face covering was causing an outrage, among the staff, to the point where they refused to serve me. The face covering in question did cover my nose and mouth to below the chin, and was held in place by straps that went behind my ears. It seems as though the controversy lay, with an additional strap that went over and behind my head, and people took offense to this. Some people in America call face masks, “face diapers”, in England they call them “face nappy’s”, I coined the term face thong, and it would appear that that was the straw that broke the proverbial camels back, the humor was lost in translation. It was not made clear if I registered customer complaints as well. The spirit of this outrage directed at me seemed to spread out to all of the checkout staff, so that it was made clear to me, that the displeasure in my face covering was not restricted to one individual, it seemed to be a shared experience by them all, and clearly reflected in their attitude toward me.
To reinforce their simpatico feelings, they will be pleased to note, that about 30 minutes earlier I was asked to leave Joe’s Restaurant while asking for a menu wearing the same face covering. It would appear that there is a universal displeasure in certain face covering styles. Personally I find displeasure in all face coverings, and in some countries it is a visible representation of tyrannical oppression of women. One would think that the women of the West would be protesting in the streets at the very suggestion that they wear face coverings when out in public, but instead we find that they are demanding it, and demanding it of others.
There is no law in any state of America that offers an accompanying civil code governing the wearing of face coverings. There are only Mandates, and Mandates are only suggestions and have no penal code violations attached to them. What any business has to offer is a trespassing violation if a person refuses to leave an establishment. Any business can refuse service to anyone at any time for any reason. However, if it is an essential service, partially financed,regulated, and described as such by Federal Law, it can become a Civil Rights violation. And a grocery store that is the only store for miles around, that receives Federal Assistance and comes under Federal control qualifies for Federal Civil Rights.
There is however no limit or qualifiers to codes that can be written by City Municipalities. If they make getting out of bed at 7am a violation of the City Code, it can come with a fine and imprisonment. While you are imprisoned, you loose your home and everything in it. It is not the Law Of The Land to wear face coverings, it is mandates by City Majors & Councils and State Governors. South Dakota has no such mandates. Proving that the Federal Government recognizes, there there is absolutely no threat of any virus to the public health of the nation as a whole.
